Using positron emission tomography (PET) and regional cerebral blood flow (rCBF) measurements, we investigated the cerebral correlates of consciousness in a sequence learning task through a novel application of the Process Dissociation Procedure, a behavioral paradigm that makes it possible to separately assess conscious and unconscious contributions to performance. Results show that the metabolic response in the anterior cingulate / mesial prefrontal cortex (ACC / MPFC) is exclusively and specifically correlated with the explicit component of performance during recollection of a (...) learned sequence. In 1949, Kurt Gödel found a solution to the field equations of general relativity that described a spacetime with some unusual properties. This “Gödel universe” permitted “closed timelike curves,” hence a kind of time travel, and it did not admit of decomposition into successive moments of time. In the same year, he published “A Remark about the Relationship between Relativity Theory and Idealistic Philosophy”, in which he used certain properties of this solution to argue for a kind of temporal idealism, (...) whereby “change [is] an illusion or an appearance due to our special mode of perception”. The paper is short and to the point, but the argument has usually been regarded as fatally flawed. Most discussions of Spinoza and consciousness—and there are not many— conclude either that he does not have an account of consciousness, or that he does have one but that it is at best confused, at worst hopeless. I argue, in fact, that people have been looking in the wrong place for Spinoza's account of consciousness, namely, at his doctrine of "ideas of ideas". Indeed, Spinoza offers the possibility of a fairly sophisticated, naturalistic account of consciousness, one that grounds it in (...) the nature and capacities of the body. Consciousness for Spinoza, I suggest, is a certain complexity in thinking that is the correlate of the complexity of a body, and human consciousness, for Spinoza, is nothing but the correlate in Thought of the extraordinarily high complexity of the human body in Extension. In this respect, Spinoza anticipates the conception of mind that is presently emerging from studies in the so-called ‘embodied mind’ research program. Abstract:In this paper, I show that certain parts of constitutional texts can plausibly be thought of as having a meaning that changes and evolves on its own. This idea is widely rejected, especially but not only by a group of legal theorists who subscribe to a theory of constitutional interpretation called originalism. In a recent paper, the originalist Lawrence Solum has defended the so-called “fixation thesis”, according to which the meaning of the constitutional text is fixed when it was first (...) enacted and does not change later on. Solum rejects the idea that the meaning of the constitutional text might evolve because he cannot identify a plausible way in which any text could have an evolving meaning. I argue that there are such texts and offer folk-fairy-tales as an example. I then go on to present reasons why constitutions can plausibly be considered to be texts that, like fairy-tales, change their meanings independently. (shrink)

Este artículo identifica los principales antecedentes legislativos y jurisprudenciales de la evidencia digital en Colombia, con miras a detallar su tratamiento en el proceso judicial; así mismo, pretende evidenciar cómo opera la cláusula de exclusión, y de qué manera se protege el derecho a la intimidad, en la obtención de evidencia digital, desde distintos medios de almacenamiento. La metodología es cualitativa y se utilizó la técnica de la revisión documental y la entrevista a expertos, para mostrar una realidad respecto a (...) una problemática de valoración de las pruebas tecnológicas, en los casos de ilicitud, y brindar aportes para mejorar la comprensión y la dimensión de su práctica en el proceso judicial. La principal conclusión es que no se le puede negar eficacia y validez probatoria por estar en forma de bytes, siempre y cuando se pueda establecer la autenticidad del contenido y la correspondencia con el autor. The interest—included intellectual history and cultural foundations of science—is: what is the role–played by La Gionta del sesto libro in the Quesiti? Is it independent booklet/speeches? If yes, when Tartaglia did write it? In this paper, I present an historical–philological–foundational hypothesis on the Tartaglia’s fortifications corpus, as exposed in the Book VI and La Gionta del sesto libro; with respect to dates of editions of Quesiti (1546, 1554). This goal is important to make historically clear both the editorial role–played by Curzio Troiano Navò (fl. 16th) in the Tartaglia’s corpus before—after Tartaglia’s death (1557) and the particular interest and development of subject of fortifications by Tartaglia between 1537–1546 and 1554. La fine del mondo costituisce uno dei temi centrali del De rerum natura, testo che rappresenta inoltre la nostra principale fonte sull'escatologia cosmica epicurea. Mosso dall'intento d'indagare questo aspetto cruciale (che non è mai stato in precedenza oggetto di studi monografici), questo libro propone un commento delle principali sezioni escatologiche del poema: i finali del primo e del secondo libro, i vv. 91-415 del quinto e la rassegna dei fenomeni meteorologici più violenti nel sesto. L'analisi delle fonti filosofiche e (...) degli obbiettivi polemici permette di dare risposte alla questione del "fondamentalismo" di Lucrezio, ponendo inoltre le basi per un esame del suo peculiare "sublime apocalittico". Le appendici forniscono ulteriori considerazioni sull'immaginario escatologico lucreziano, concentrandosi sul modello offerto da Empedocle, le strategie comunicative del poeta e la possibile influenza del trattato pseudo-aristotelico De mundo. Questo esame mostra che il poeta richiama dottrine e fonti filosofiche successive a Epicuro, senza però cadere nell'eclettismo: uomo del suo tempo, Lucrezio "attualizza" le dottrine del maestro, proponendole come risposta per le angosce della propria epoca. El objetivo de este artículo es demostrar que la obra del sociólogo del conocimiento científico Steven Shapin es heredera del debate internismo/externismo. Esa herencia se expresa a través de los intentos que realiza por romper los límites de las dicotomías que fueron construidas en el curso de la controversia en los ámbitos disciplinares de la historia de la ciencia, la sociología de la ciencia y la sociología del conocimiento científico. Abordaremos principalmente las cuestiones concernientes a la relación entre la (...) obra de Shapin de los años noventa y los trabajos de Robert Merton, uno de los pilares del debate.The aim of this paper is to show that the work of the sociologist of scientific knowledge Steven Shapin is inheriting from the internalism/externalism debate. That inheritance is expressed by the attempts that he makes to break the boundaries of the dichotomies, which were built during the dispute in the disciplinary fields of history of science, sociology of science and sociology of scientific knowledge. We will deal with the issues concerning the relation between Shapin’s work during the nineties and Robert Merton’s work, which was one of the pillars of this debate. (shrink)

There is a credibility decay on positive knowledge among the social scientists and particularly among the psychologists. Certainly different prejudices dwell upon this phenomenon. First and principal the usually made identity of positive and natural knowledge. This belief is also fed by many others such as that one which assumes that every quantification, which is a consequence of positive knowledge,follows the model of the Physical Sciences. We consider that all these prejudices do not keep in mind the work done in (...) the last decades on the Theories of Measure. We consider also that psychophysical methods which have been introduced by Stevens present a stimulating program for the behavioral sciences and they open a new frontiere to the positive knowledge. In the last 2500 years, since the beginnings in ancient Greece of the literary genre we call “history,” the relationship between history and law has been very close. True, the Greek word historia is derived from medical language, but the argumentative ability it implied was related to the judicial sphere. History, as Arnaldo Momigliano emphasized some years ago, emerged as an independent intellectual activity at the intersection of medicine and rhetoric. Following the example of the former, the historian analyzed specific (...) cases and situations looking for their natural causes; following the prescriptions of the latter—a technique, or an art, born in tribunals—he communicated the results of his inquiry.2Within the classical tradition, historical writing had to display a feature the Greeks called enargeia, and the Romans, evidential in narrtatione: the ability to convey a vivid representation of characters and situations. The historian, like the lawyer, was expected to make a convincing argument by communicating the illusion of reality, not by exhibiting proofs collected either by himself or by others.3 Collecting proofs was, until the mid-eighteenth century, an activity practiced by antiquarians and erudite, not by historians.4 When, in his Traité des differentes sortes de preuves qui servent à établir la vérité he l’histoire , the erudite Jesuit Henri Griffet compared the historian to a judge who carefully evaluates proofs and witnesses, he was expressing a still-unaddressed intellectual need. _Abstract_: In this paper, I will examine the Goldstein-Cassirer approach to neuropathology to determine its current potential for yielding valuable insights. To this end, I will reconstruct the philosophical and theoretical underpinnings of such a standpoint in the first four sections. What will emerge is that it entails a definition of pathology as the loss of balance in the adaption of human beings to the environment, leading to a lack of proclivity to categorical behaviour and symbolic performances. In the fifth section, I will compare and contrast the holistic stances with current research in neuropsychology. Motive and Rightness is the first book-length attempt to answer the question, Does the motive of an action ever make a difference in whether that action is morally right or wrong? Steven Sverdlik argues that the answer is yes. His book examines the major theories now being discussed by moral philosophers to see if they can provide a plausible account of the relevance of motives to rightness and wrongness. Sverdlik argues that consequentialism gives a better account of these matters (...) than Kantianism or certain important forms of virtue ethics. In carrying out the investigation Sverdlik presents an analysis of the nature of motives, and he considers their relations to normative judgments and intentions. A chapter is devoted to analyzing the extent to which motives are 'available' to rational agents, and the importance of feelings and unconscious motives. Historical figures such as Kant, Bentham, Mill and Ross are discussed, as well as contemporary writers like Korsgaard, Herman, Hurka, Slote and Hursthouse. With armed conflict in the Persian Gulf now upon us, Harvard archaeologist Steven LeBlanc takes a long-term view of the nature and roots of war, presenting a controversial thesis: The notion of the "noble savage" living in peace with one another and in harmony with nature is a fantasy. In Constant Battles: The Myth of the Peaceful, Noble Savage , LeBlanc contends that warfare and violent conflict have existed throughout human history, and that humans have never lived in ecological (...) balance with nature. The start of the second major U.S. military action in the Persian Gulf, combined with regular headlines about spiraling environmental destruction, would tempt anyone to conclude that humankind is fast approaching a catastrophic end. But as LeBlanc brilliantly argues, the archaeological record shows that the warfare and ecological destruction we find today fit into patterns of human behavior that have gone on for millions of years. Constant Battles surveys human history in terms of social organization-from hunter gatherers, to tribal agriculturalists, to more complex societies. LeBlanc takes the reader on his own digs around the world -- from New Guinea to the Southwestern U.S. to Turkey -- to show how he has come to discover warfare everywhere at every time. His own fieldwork combined with his archaeological, ethnographic, and historical research, presents a riveting account of how, throughout human history, people always have outgrown the carrying capacity of their environment, which has led to war. Ultimately, though, LeBlanc's point of view is reassuring and optimistic. As he explains the roots of warfare in human history, he also demonstrates that warfare today has far less impact than it did in the past. In recent years there has been an increased interest in the application of Aristotelian virtue to business ethics. The objective of this paper is to describe the moral and intellectual virtues defined by Aristotle and the types of pedagogy that might be used to integrate virtue ethics into the business curriculum. Virtues are acquired human qualities, the excellences of character, which enable a person to achieve the good life. In business, the virtues facilitate successful cooperation and enable the community to (...) achieve its collective goals. The cultivation of virtue in students requires imparting knowledge about virtue and training students to be virtuous. A variety of instructional techniques are discussed including using case studies, collaborative and cooperative learning, role-playing, and video presentations. Business educators should emphasize to students that virtue considerations apply both to possible actions they may take and to themselves as moral agents. Since faculty may be viewed as role models, it is especially important that they set proper standards of behavior for students to emulate. (shrink)

This short work examines what the Hippocratic Oath said to Greek physicians 2400 years ago and reflects on its relevance to medical ethics today. Drawing on the writings of ancient physicians, Greek playwrights, and modern scholars, each chapter explores one passage of the Oath and concludes with a modern case discussion. This book is for anyone who loves medicine and is concerned about the ethics and history of the profession.

Medical research is widely thought to have a fundamentally therapeutic orientation, in spite of the fact that clinical research is thought to be ethically distinct from medical care. We need an entirely new conception of clinical research ethics—one that looks to science instead of the doctor‐patient relationship.

Several prominent philosophers have argued that the fact that depressed agents sometimes make moral judgments without being appropriately motivated supports Humean externalism – the view that moral motivation must be explained in terms of desires that are distinct from or “external” to an agent’s motivationally inert moral judgments. This essay argues that such motivational failures do not, in fact, provide evidence for this view. I argue that, if the externalist argument from depression is to undermine a philo-sophically important version of (...) internalism, it must make use of a general assumption about motivational states. However, at a reasonable level of abstraction, the needed assumption also implies that even desires could not be effective sources of motivation. For, just as depressed agents might sometimes lack motivation to act consistently with their moral judgments, they also sometimes lack motivation to pursue their desires. Moreover, the most plausible responses that Humeans can give to this general argument undermine the externalist case against internalism. Thus, there is a deep tension between the argument from depression for externalism and a fundamental Humean commitment. (shrink)
